More Trouble At Hand For In-Flight Masturbator
Feds want perv jailed over halfway house misconduct
JUNE 23--The Florida man who this month pleaded guilty to masturbating on a recent United Airlines flight is “being expelled” from a halfway house and may end up back in a federal prison cell due to repeated instances of misconduct at the facility, according to a court filing.
Federal prosecutors in Denver yesterday filed a motion seeking the immediate revocation of Kyle Pearce’s bond since he has “repeatedly failed to comply with the rules and regulations” of the halfway house. They also asked a U.S. District Court judge to issue an arrest warrant for the 25-year-old, who is pictured in the adjacent mug shot.
Pearce was arrested May 19 by FBI agents after he “masturbated to the point of ejaculation” while traveling on a flight to Denver from Spokane, Washington. Pearce pleasured himself while seated next to an 18-year-old high school student. In a written statement, the young woman recalled that she spotted Pearce masturbating and that he “ejaculated & got some on the seat. Then he went to the bathroom for a long time.”
Several days after his arrest, Pearce was released on $25,000 bond and ordered to reside in the Independence House halfway house, where he could undergo “mental health and counseling” treatment. Pearce pleaded guilty to a misdemeanor count on June 10, and was scheduled to be sentenced on August 19.
According to a memo from Garret Pfalmer, a senior probation officer, Pearce has repeatedly been “engaging in misconduct” during his month-long stay at Independence House. Along with “associating with female residents” at the coed facility, Pearce has been disrespectful to staff and “is either abusing his medications, or he is providing them to other residents.”
Among other alleged misconduct, Pearce has abused prescription medicines, gone AWOL from the halfway house, and got into a physical altercation with another resident. Additionally, during an appointment last week at a medical facility, a nurse caught Pearce “attempting to steal needles, syringes, and alcohol pads.” He also apparently filled fraudulent prescriptions at a Walgreen’s pharmacy.
Pfalmer concluded that Pearce “has been found to show no desire to follow the rules and regulations” set forth by the halfway house. “The defendant’s physical safety has now become a concern and he is no longer viewed as being acceptable for placement at the facility.”
A hearing has yet to be scheduled on the prosecution’s motion to revoke Pearce’s bond and have him arrested. (2 pages)
