Gordon Divorce Going To The Videotape?

The estranged wife of NASCAR star Jeff Gordon has "highly confidential and sensitive" surveillance materials that were gathered in advance of her March 15 divorce filing in Palm Beach, Florida, The Smoking Gun has learned.

In a recent Circuit Court filing, lawyers for Brooke Gordon, 32, disclosed the existence of the surveillance materials--as required by court discovery rules--in response to a request by Jeff Gordon for a variety of documents and records. Specifically, Jeff Gordon sought "any and all surveillance materials in connection with this action," including "video and/or audio tapes, photographs, reports, correspondence, notes, memoranda, etc."

In this May 17 answer to Jeff Gordon's request, Jeffrey Fisher, a lawyer for Brooke Gordon, objected to turning over the "surveillance material in the wife's possession" since it was "work-product" exempt from pre-trial discovery. In a brief interview Friday, Fisher declined to discuss the nature of the surveillance, but did tell TSG, "the bottom line is that this is highly confidential and sensitive material and I'm not going to comment on it."

In the divorce petition, Brooke Gordon claimed that her marriage was "irretrievably broken" as a result of the 30-year-old race car driver's "marital misconduct." She is seeking an "equitable distribution" of the couple's assets, which are "in excess of $40,000,000," according to a May 2 filing by Jeff Gordon's legal team. (2 pages)
